Speaker

Mr. He has more than 20 years’ experience in China intellectual property practice for clients at home and abroad. He started his legal career as a patent attorney at a major Silicon Valley law firm and spent about 9 years in an international law firm’s leading IP group. A number of his cases were listed as top intellectual property cases by Chinese judiciary authorities. Major industrial associations often consult with Mr. He on China legal and policy matters. Mr. He’s specialty relates to cross-border technology licensing and policy consulting in sustainable development fields.

James has over 30 years of experience in IP. He’s recognised as one of the UK’s leading patent litigators, and is best known for his work in the technology and life sciences sectors. Although the majority of James’ work is in patent litigation across the telecoms, pharmaceuticals and life sciences sectors, he regularly advises on non-contentious cases with a high degree of technical complexity. James has worked on numerous trade secrets claims and contractual disputes. He’s also experienced in licensing and other transactional matters involving IP.

Michael specialises in Tech and Life sciences patent litigation. Michael has advised a wide range of clients from multinational companies to SMEs on patent matters across a variety of technologies including pharmaceuticals, medical devices and telecommunications. He has experience of advising clients in relation to multinational litigation across Europe, and in European Patent Office proceedings. Michael also has a particular focus on the relationship between intellectual property rights and competition law.

Phillip is a certified specialist lawyer for intellectual property law and has been handling patent litigation for national and international companies for many years, particularly in an international context. He represents clients in the fields of IT/electronics, pharma/life sciences and mechanics/automation. He also has extensive experience in trade fair matters – both in the enforcement and defence of rights. Another main focus is on advising clients in the fields of robotics, industry 4.0, IoT and artificial intelligence.

Xiaoyu Feng is a Senior C.V. Starr Lecturer of Law and Director of Externships at Peking University School of Transnational Law (‘STL’). Prior to joining STL, she worked for Sidley Austin LLP and Holland & Hart LLP, and in-housed for multinational telecommunications company and international consumer goods company. Her professional experiences include serving Fortune Global 500 of mechanical equipment, telecommunications, biotechnology, and pharmaceutical enterprises with areas of focus on corporate governance, commercial litigation, intellectual property protection, cross-border mergers and acquisitions, and international commercial arbitration and dispute resolution.

Abstract

Recently, the Intellectual Property Chamber of the Supreme People’s Court in China made a final ruling regarding the jurisdictional objection in the SEP proceedings between OPPO and SHARP, clarifying for the first time the jurisdictional rules for the global licensing of SEPs. The ruling is of great significance to the Chinese court’s shift to actively participating in and leading the SEP disputes and rule-making for global standards. Over the past year, courts in various countries have adopted different rules regarding parallel SEP litigations. Beginning this year, Ericsson v. Apple officially ushered in the war on 5G SEP licensing. Peking University School of Transnational Law invites Taylor Wessing and GEN Law Firm to discuss the SEP case law in China, UK and Germany and share insights on SEP litigation strategies.
