STL Judicial Case Study Center

The "Judicial Case Study Center" (JCSC) is one of the key academic seminar organizations of the School of Transnational Law (STL) at Peking University, founded by Professor Huang Hui. JCSC concentrates on the study of significant and complex legal cases and judicial adjudication techniques, aiming to provide academic support for the uniform application of law and the standardized exercise of discretion.

The essence of the rule of law is to apply a uniform and universal adjustment to identical situations in social life through typification of rules. The phenomenon of "different judgments for similar cases" that currently exists to a certain extent has increasingly negative impacts on judicial credibility. The essence behind this phenomenon is the lack of uniformity in the application of legal standards. On December 1, 2021, the Supreme People's Court issued the "Implementation Measures for the Unification of Legal Application by the Supreme People's Court," which emphasized the need to achieve "the same judgment for identical cases" across the nation. The significance of case studies in achieving this goal is undeniable. Since the first batch of guiding cases was published on January 10, 2012, the Supreme People's Court has released 39 batches totaling 224 guiding cases, with the number and frequency of releases steadily increasing. Additionally, the High People's Courts of the provinces have been actively publishing typical cases in various fields as models for lower courts to reference in their judicial decisions. As the integration and exchange among different legal systems progress, the role and importance of case law in civil law countries are increasingly highlighted. Learning from precedents and utilizing their normative and guiding roles has become a self-improvement mechanism of the judicial adjudication system. Therefore, the study of classical, complex, and significant cases is an essential requirement to enhance the guiding role of cases and provide support for the continuous improvement of judicial adjudication techniques.

Peking University School of Transnational Law is the only law school in China that offers an American law education program (J.D.) and is the only law school on earth that combines the American Juris Doctor (J.D.) program with the traditional Chinese Juris Master (J.M.) program. During the process of receiving American legal education, students become thoroughly familiar with case study and discussion, the comparison of similar cases, and the interpretation of adjudication rules. After receiving systematic education in Chinese law, they have significant advantages in studying and applying guiding cases for major and complex cases under the Chinese legal framework.

In this context, JCSC's academic research activities focus on two main aspects: first, by analyzing and studying major and complex cases, we explore the improvement of judicial adjudication techniques, particularly addressing the issue of "the same judgment for identical cases"; second, we translate the guiding cases issued by the Supreme People's Court into English and provide them as alternative official versions. This is to facilitate a better understanding of the Chinese legal system for the international legal community, to promote dialogue and exchange between different legal systems, and to contribute Chinese wisdom and experience to global legal studies.
