Abstract:

Corruption—especially bribery—is a significant legal and business risk for multinational firms, especially those working in emerging markets. When a firm’s employees or agents pay bribes to government officials, or engage in other forms of corrupt conduct, they may be subject to prosecution not only under the laws of the country where the bribes were paid, but also under the laws of their home jurisdiction, and potentially other jurisdictions as well. This panel will consider how lawyers in a variety of roles and practice areas help their clients address, mitigate, and manage corruption risks, and will also explore more general legal and policy questions regarding the legal framework for regulating transnational corruption.
